It’s claimed the conviction of a former Irish soldier of being a member of Islamic State ‘falls short of Irish law’.
43-year-old Lisa Smith, of Dundalk in County Louth, is appealing her 2023 conviction, which will now have to go into a third day.
She travelled to Syria after converting to Islam in 2015.
Her counsel Michael O’Higgins SC told the three-judge Court of Appeal that deeming someone a member of a terrorist organisation by travelling to Syria is ‘a flawed approach’.
Earlier, he said “membership is not done by osmosis”, adding that there must be some sort of application and acceptance to become a member.
In his submissions, Tony McGillicuddy SC said Mr O’Higgins was trying to apply the parameters of being a member of a GAA Club or so forth – adding that membership of one organisation is different to the membership of another.
The case returns on Tuesday, April 29th.
